Walk With Dogs Terms of Service and App Information

These Terms of Service (the “Terms”) set forth the conditions of use for the application “Walk With Dogs” (the “App”) provided by Skye (the “Operator”).
Users shall use the App only after agreeing to these Terms.
Article 1 (Application)
These Terms apply to all relations between users and the Operator in connection with the use of the App.
If individual notices or other conditions are displayed within the App, they shall also form part of these Terms.
If any individual condition conflicts with these Terms, the individual condition shall prevail.
Article 2 (Content of the App)
The App primarily provides the following functions.
- Acquiring and displaying step counts
- Switching dog cards and comments every 1,000 steps
- Displaying daily, weekly, and monthly records
- Setting a daily step goal
- Displaying achievement rate and status toward the goal
- Displaying dog cards, rare cards, the album, and goal-achievement effects
- Favorites and My Card
- Following the device language and allowing manual language selection
- Paid Premium features
- Other related functions provided within the App
Dog cards and rare cards may include cards that use different photos, backgrounds, comments, or effects for the same dog.
The Operator may change, add to, or discontinue the content, functions, display, design, or terms of provision of the App as necessary.
The App is an entertainment and lifestyle-support app intended to make walking enjoyable and sustainable. It is not intended for medical practice, diagnosis, treatment, disease prevention, assessment of health conditions, or professional advice.
Article 3 (Step Data)
The App acquires step counts using the device's motion and fitness features, based on the user's permission.
The motion-related data acquired by the App is, in principle, limited to step counts.
Acquiring step counts requires granting the necessary device permission.
The App aggregates steps on a daily basis, from 12:00 a.m. to 11:59 p.m.
If the device, OS, or usage environment does not support step acquisition, steps may not be displayed or recorded.
Step counts may differ from the actual number of steps taken or from the figures shown by other apps, depending on the device, OS, how the device is carried, permission settings, and other conditions.
The Operator does not guarantee the completeness, accuracy, immediacy of step counts, achievement rates, or other figures, or their consistency with other services.
Article 4 (Permissions and Usage Environment)
The step-counting function requires permission to access the device's motion and fitness features.
Access to the photo library is requested only when the user sets a photo for My Card.
If the necessary permissions are not granted, some functions may be unavailable.
Users may change or revoke each permission from the device settings.
Due to specification changes in the OS, the device, or external services, all or part of the App may become unavailable.
The device costs, communication charges, and other expenses necessary to use the App shall be borne by the user.
Article 5 (Step Goals and Records)
Users may freely set a daily step goal within the range prescribed by the App.
The step goal, achievement rate, achievement status, and records are reference information intended to support walking.
Users should use the App within reasonable limits, taking into account their own physical condition, fitness level, age, weather, road conditions, and other circumstances.
Step history and achievement status may not be saved or displayed correctly, depending on the condition of the device or OS.
Article 6 (Safe Use)
When using the App, users must observe the following.
- Not staring at the device screen while walking
- Complying with the Road Traffic Act and other applicable laws
- Prioritizing surrounding safety on roads, at intersections, on stairs, at steps, and in other hazardous locations
- Not operating the App while driving a vehicle, bicycle, or similar
- Stopping walking or use of the App if experiencing poor physical condition, pain, severe fatigue, or other abnormalities
- Following the instructions of a physician or other professional if subject to exercise restrictions
- Minors should use the App with the consent or supervision of a parent or guardian as necessary
If a minor purchases a paid feature, the prior consent of a legal representative shall be obtained.
Article 7 (Prohibited Acts)
Users shall not engage in any of the following acts.
- Acts that violate laws or public order and morals
- Criminal acts or acts related thereto
- Acts that infringe the copyright, trademark rights, right of publicity, privacy rights, or other rights of the Operator or any third party
- Acts that interfere with the operation of the App
- Acts of unauthorized access to the App
- Acts of unlawfully modifying, analyzing, copying, redistributing, decompiling, disassembling, or reverse-engineering the App, except where permitted by law
- Acts of exploiting a defect in the App for an unlawful purpose
- Acts of using the App or its content for commercial purposes without the permission of the Operator or the rights holder
- Any other act that the Operator reasonably determines to be inappropriate for the operation of the App
Article 8 (Intellectual Property Rights, Photo Materials, and Credits)
The copyright, trademark rights, and other intellectual property rights relating to the program, design, logo, text, comments, structure, and other content of the App belong to the Operator or the lawful rights holder.
The dog photos and other materials used in the App include materials obtained from Pexels, Unsplash, and other material-providing services, and are used in accordance with the license and other terms of use applicable at the time of acquisition.
The copyright, trademark rights, right of publicity, and other rights relating to third-party-provided materials belong to the respective photographers, creators, providers, or other lawful rights holders.
The Operator endeavors to use materials for which in-app use, commercial use, and necessary modification are permitted, based on the terms of use that could be confirmed at the time of acquisition.
The photos and other materials in the App are used as part of the overall app experience, including steps, comments, cards, and effects, and are not intended for the distribution or sale of the photo materials themselves.
Except where permitted by law or expressly authorized by the Operator or the rights holder, users shall not extract, copy, reproduce, modify, redistribute, sell, publish, or compile into a materials collection any photos, videos, illustrations, text, or other materials contained in the App.
Any rights holder or related party who believes there is a rights infringement or other issue concerning materials in the App should contact the inquiry desk set forth in Article 20.
The Operator will review the content of any such notice and, as necessary, take appropriate measures such as suspending display of, replacing, or removing the material in question.

Article 9 (On-Device Data)
The App's settings, step history, step goal, achievement status, My Card photos/names/comments, and other data are, in principle, stored on the user's device.
The Operator does not provide its own cloud backup or restoration service for on-device data.
Data may be lost due to app deletion, device malfunction, loss, factory reset, device replacement, OS updates, storage failure, or other reasons.
If the App is deleted, the data stored on the device by the App will normally be deleted as well. However, behavior may vary depending on the device's or OS's backup and restore settings.
The Operator does not guarantee the storage, retention, restoration, or integrity of on-device data.
Article 10 (Paid Features)
The App offers paid Premium features.
Premium features are provided through in-app purchases on the Apple App Store, Google Play, or other stores that distribute the App.
Premium features are a one-time purchase and are not an auto-renewing subscription.
The actual sale price shall be the price displayed on the respective store at the time of purchase.
Purchases, payments, purchase history, purchase restoration, cancellations, and refunds are subject to the terms and procedures of each respective store.
After changing devices or reinstalling the App, if the user is using the same store account, the purchase restoration function provided by the store may be available.
The Operator may change the content, price, or terms of provision of Premium features in accordance with applicable laws or the terms of each store.
Article 11 (Changes, Suspension, and Termination of the Service)
The Operator may change, suspend, or terminate all or part of the App in any of the following cases.
- When performing maintenance, inspection, or updates
- When the specifications of the device, OS, app distribution store, or other external services are changed
- When a natural disaster, power outage, communication failure, system failure, or other force majeure event occurs
- When it is necessary to respond to laws, government authorities, or the policies of the app distribution store
- In other cases reasonably determined by the Operator to be necessary for operations
Where possible, the Operator will provide notice within the App or by other appropriate means.
Article 12 (Disclaimer of Warranty)
The Operator does not warrant any of the following with respect to the App.
- That it will be available at all times
- That no defects, failures, or errors will occur
- That it is suitable for a user's particular purpose
- That step counts, achievement rates, and other figures are complete or accurate
- That it will operate on all devices, OSes, or external services
- That data will not be lost
- That the same functions will continue to be provided in the future
Information obtained from the App is for reference only, and users shall use it based on their own judgment and responsibility.
Article 13 (Limitation of Liability)
The Operator shall not be liable for any damage that arises without the Operator's intent or negligence.
If damage is caused to a user due to the Operator's slight negligence, the Operator's liability shall be limited to actual, direct, and ordinary damage incurred.
The preceding paragraph applies to both the free and paid features of the App.
The limitations set forth in the preceding paragraphs shall not apply in cases of the Operator's intent or gross negligence, or where a limitation of liability is not permitted by law.
This Article does not limit a user's rights to the extent not permitted under the Consumer Contract Act or other mandatory laws and regulations.
Article 14 (Third-Party Services)
The App uses the device's motion feature, photo selection feature, app distribution store, and functions relating to in-app purchases and purchase restoration.
Third-party services are subject to the terms, privacy policies, and other conditions set by their respective providers.
All or part of the App may become unavailable due to suspension, failure, or specification changes of device features or external services.
Article 15 (Privacy)
The Operator's handling of information is governed by the separately established “Walk With Dogs Privacy Policy.”
Article 16 (Changes to These Terms)
The Operator may amend these Terms as necessary in accordance with applicable laws.
When making a change that materially affects users' rights or obligations, the Operator will provide advance notice of the content of the change and its effective date within the App or by other appropriate means.
For changes that require a user's individual consent under applicable law, the Operator will obtain such consent by the necessary means.
Article 17 (Assignment of Rights and Obligations)
Users may not assign or transfer their status, rights, or obligations under these Terms to any third party without the Operator's prior consent.
If the Operator transfers the business relating to the App to a third party, the Operator may, in accordance with applicable law, transfer its status, rights and obligations, and other necessary information under these Terms to the transferee.
Article 18 (Severability)
Even if part of these Terms is determined to be invalid or unenforceable under applicable law, the remaining parts shall continue to be valid.
Article 19 (Governing Law and Jurisdiction)
These Terms are governed by, and shall be interpreted in accordance with, the laws of Japan.
In the event of a dispute relating to the App or these Terms, the Saitama District Court shall have exclusive agreed jurisdiction as the court of first instance.
The preceding paragraph does not unduly exclude any jurisdiction available under laws applicable to consumer contracts or otherwise.

Article 21 (Language)
If these Terms are translated into a language other than Japanese, and there is any discrepancy between the Japanese version and the translated version, the Japanese version shall prevail to the extent permitted by law.
